These Terms of Service ("Terms") govern your use of the Ripa Elevate platform. By creating an account or using our services, you agree to these Terms.
Ripa Elevate is an adaptive educational assessment tool designed for learners of any age, including those with IEPs and different learning needs. It provides skill-level assessments across nine categories and generates plain-language reports for parents.
Ripa Elevate is not a clinical evaluation, diagnostic tool, or medical device. Our assessments are educational in nature and are not intended to replace formal psychoeducational evaluations, Independent Educational Evaluations (IEEs), or any assessment conducted by a licensed psychologist, school psychologist, or other qualified professional. Results should not be used as the sole basis for educational placement, eligibility, or clinical decisions.
Our reports are designed to give parents additional insight into their child's functional skills. They may be shared with educators, therapists, or IEP teams as supplemental information, but they do not carry clinical or diagnostic weight.
You must be 18 years or older to create an account. Accounts are for parents or legal guardians to use on behalf of their children. You are responsible for maintaining the security of your account credentials and for all activity under your account.
Ripa Elevate offers monthly ($49/month) and annual ($399/year) subscription plans. All plans include a 7-day free trial. Your payment method will be charged automatically at the end of the trial period unless you cancel before then.
Subscriptions renew automatically. You may cancel at any time through Stripe's customer portal or by contacting us. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.
Each skill category can be reassessed once every 30 days per child. This policy is enforced automatically by the platform and is designed to ensure meaningful growth measurement between assessments.

All content on the Ripa Elevate platform, including questions, reports, design, and code, is the property of Ripa Elevate and is protected by copyright. You may print or download your child's assessment reports for personal or educational use. You may not reproduce, distribute, or sell any platform content.
Ripa Elevate is provided "as is" without warranties of any kind. We do not guarantee that assessment results will be accepted by any school, district, or educational institution. To the maximum extent permitted by law, our total liability for any claim arising from your use of the platform is limited to the amount you paid us in the 12 months preceding the claim.
We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time by contacting us. Upon deletion, all personal data and assessment records will be permanently removed.
We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use after changes constitutes acceptance.

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute arising from these Terms or your use of Ripa Elevate will be resolved in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.
Before filing any legal claim, you agree to contact us at michelle@ripaelevate.com and attempt to resolve the dispute informally for at least 30 days. If the dispute cannot be resolved informally, both parties agree to binding arbitration under the rules of the American Arbitration Association, conducted in New York, NY. You waive any right to participate in a class action lawsuit or class-wide arbitration.
